Municipal Legal: River Hills Village Attorney (1990 - ), Village of Shorewood, Assistant Village Attorney in his capacity as Of Counsel to the Firm (1995 - ). Village of Brown Deer (as Assistant Village Attorney and as Village Attorney 1985 - 2006). Attorney for the North Shore Fire Department a sec.66.0301 jointly owned and operated fire and emergency services department (1995 - ).
Legal experience on behalf of municipal clients, including matters such as local television station's public record request litigation; forming non-profit municipal civic organizations and filing of IRS Sec. 501(3)(c) applications; tax assessment and exemption litigation in Circuit and Appellate courts; working with local officials during investigation of police department; special use and conditional use permit zoning applications and litigation; defending Board of Appeals decisions in Circuit and Appellate courts; review and drafting of development agreements; negotiations and drafting of cellular/wireless facilities contracts; formation of Community Development Authority and Bond issues (not as Bond counsel); water utility litigation; PECFA appeals; real estate acquisitions and sales; litigation involving appeals of Police Commission decisions; and FEMA Hazard Mitigation Grant land purchases related to flood damaged properties.
Transportation Legal: Represented motor carriers and shippers in the areas of freight loss and damage claims, including “Carmack” claims and defenses, preemption, limitation of liability, notice of claim defenses, broker liability, condition of goods upon delivery and receipt, delay and damages (including consequential and special damages); federal and state administrative regulations, including safety regulations and hazardous materials regulations; drafting of transportation tariffs and contracts including negotiations; and litigation in federal and state courts over issues arising from tariffs, transportation contracts, undercharge litigation, freight claims, freight charges, scope of ICC authority, common carrier duty to serve and authority to abandon rail service. Litigation with rail carriers on behalf of commercial shippers related to freight damages, freight charges and abandonment of rail service including approximately four years of successful litigation in the Northern District of Illinois on behalf of a group of companies related to the Milwaukee Road Bankruptcy and abandonment of rail service to multiple shippers.
